Brad is a trial attorney with extensive experience in defending high-profile, high-exposure litigation in cases involving mass torts, products liability, commercial disputes and environmental contamination locally, regionally and nationally.
One of Brad’s principal areas of focus is defending clients in torts related to exposure to chemicals, mixed chemicals and other toxic substances, such as PFAS, benzene, dioxane, formaldehyde, PCBs, silica and asbestos, and with claims arising under New York’s Navigation Law and CERCLA. He also has a great deal of experience with cases involving alleged catastrophic injuries, including burns. He is adept at deposing opposing expert witnesses in various fields, including industrial hygienists, toxicologists, epidemiologists and medical doctors to highlight uncertainties in their opinions. Brad has represented long-term care facilities in the wake of COVID and Legionella epidemics.
Brad also defends clients in commercial litigation in the insurance/reinsurance, construction, logistics/trucking, hospitality and housing industries. He represents insurers/reinsurers in disputes related to premium allocations and insurers in coverage disputes, including the rescission of insurance policies. Brad has prepared experts in acturial science and underwriting for deposition and trial testimony, and has deposed and cross-examined opposing experts in these areas at trial and arbitration. He also represents building owners in litigation with general contractors and hotel operators in disputes with owners and outside vendors. Brad also represents real estate developments in government investigations.
Prior to joining Harris Beach Murtha, Brad served as an Assistant Corporation Counsel in the New York City Law Department. As a member of the Tort Division’s Special Litigation Unit, Brad defended the City in complex and high exposure tort lawsuits, including actions involving wrongful death, catastrophic injuries, sexual abuse and civil rights violations. He also represented the City in false arrest/malicious prosecution claims and lawsuits, and obtained summary judgment and dismissal of false arrest and civil rights claims that was affirmed on appeal.
