He advises on complex environmental remediation strategy, environmental due diligence in M&A and real estate transactions, navigating environmental and land use permitting, and on achieving and maintaining regulatory compliance.
His practice includes representing:
- Large-scale real estate developers in brownfield remediation and redevelopment projects, including federal Superfund sites and projects pursuing incentives through the New York State Brownfield Cleanup Program (BCP); members of regulated industries in achieving and maintaining regulatory compliance with the New York State Department of Environmental Conservation (DEC); and coordinating environmental review and land-use considerations for multifaceted redevelopment projects, such as affordable housing, senior affordable housing, mixed-use commercial, recreational facilities, parks and schools.
- Renewable energy and infrastructure developers, advising on nuanced environmental and land use permitting obligations associated with the New York State Environmental Quality Review Act (SEQR), the New York State Freshwater Wetlands Act, local approval processes, the Clean Water Act (CWA), the Clean Air Act (CAA) and the Endangered Species Act (ESA).
- Institutional multifamily landlords and property managers in all aspects of building systems environmental compliance, with a focus on lead-based paint (LBP) regulation, radon, asbestos, mold, Legionnaire’s and Safe Drinking Water Act (SDWA).
- Buy-side, sell-side, and lending interests in diligencing and de-risking complex environmental exposures in mergers and acquisitions (M&A), as well as traditional real estate transactions.
Aaron also works on development matters involving environmental permitting, SEQR, local approvals and other federal, state, and municipal regulatory frameworks, including the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), New York Freshwater Wetlands Act, the Coastal Zone Management Act (CZMA), State Pollutant Discharge Elimination System (SPDES), and New Jersey’s Site Remediation Reform Act and Licensed Site Remediation Professional program.
