Mathew represents developers, corporations and municipalities in zoning and land use applications and related litigation. He is experienced in both prosecuting and defending N.Y. C.P.L.R. article 78 proceedings and plenary actions.  Mathew negotiates real estate transactions, including purchase and sale contracts and commercial loan financing agreements. Mathew also represents municipalities in a wide range of legal matters and appellate practice, and has argued before the Appellate Division, Second Department.

Prior to joining Harris Beach Murtha, Mathew worked for a national law firm where he focused on zoning and land use, municipal litigation and toxic tort matters, including asbestos claims. Notably, he defended a public benefit corporation in the World Trade Center Lower Manhattan Disaster Site litigation, helping to manage discovery, depositions and summary judgment motions in that complex litigation.

During law school, Mathew interned for the Hon. Thomas C. Platt of the United States District Court for the Eastern District of New York, focused study in Real Estate Law and achieved the CALI Excellence for the Future Award in Real Estate Practice. He also served as the associate editor of the Brooklyn Journal of International Law.

  • Represented developer in successfully prosecuting claims pursuant to Article 78 to overturn, as arbitrary and capricious, a village zoning board’s denial of developer’s land use application.
  • Drafted financing agreements and helped close a commercial real estate loan for $11 million dollars for a mixed-use parcel in the downtown area of a local village.
  • Assisted in the defense of public entity that, as an owner of buildings in Lower Manhattan after 9/11, was sued by asbestos removal workers claiming exposure to toxic dust, and prevailed on summary judgment in a landmark decision in the Southern District of New York.
