David focuses his legal practice on defending clients in toxic torts and products liability cases, and has litigated cases in New York, New Jersey, and Pennsylvania state courts as well as multiple federal courts around the country.  He has defended clients in toxic tort cases involving exposure to pharmaceutical drugs, lead, mold, and asbestos that allegedly caused a variety of injuries including cancer, respiratory issues, developmental delays, and cognitive functioning. David has also litigated cases involving construction and property defects, long-term care facilities, contract disputes, New York Labor Laws, ERISA and Medicare Advantage Organization liens, and personal injury matters.

His experience includes defending companies in mass torts, coordinated litigations, and multidistrict litigations in both state and federal courts.  These matters required David to draft pleadings, removal notices, discovery requests and responses, discovery deficiency letters, mediation submissions, research memos, and discovery plans in national pharmaceutical products liability litigation.  He has organized and managed the exchange of fact sheets in federal and state coordinated litigation.  David has managed large e-discovery projects that included drafting extensive coding manuals, identification of personal identifying and confidential material, and negotiating the scope of discovery.  His experience includes a wide-variety of motion practice, including drafting and arguing motions to dismiss, motions to compel, motions in limine, forum non conveniens motions, motions for summary judgment, and expert-related motions.  He has deposed plaintiffs, defendants, corporate representatives, treating physicians, and liability experts.  He has participated in arbitrations and mediations in New York, New Jersey, and Pennsylvania courts.

  • Won summary judgment and double damages for Medicare Advantage Organization under Medicare Secondary Payer Act when primary plan tortfeasor failed to appropriately reimburse MAO.
