While Richard represents clients in all areas of intellectual property law, the center of his practice is patent litigation and patent prosecution. He has extensive first-chair patent litigation experience with an emphasis on counseling and representing generic drug companies in Hatch-Waxman proceedings.

He has successfully represented generic drug companies at both the trial and appellate levels and has been involved in preparing numerous patent opinions and Paragraph IV notice letters. He has litigated patent cases in a variety of technical fields in district courts throughout the United States, including numberous cases in the District of Connecticut, before the USPTO in post grant proceedings, and at the International Trade Commission.

In addition to pharmaceuticals, Richard has experience in other technical fields, including high precision aerospace bearings, semi-conductor nanoparticles, intracranial precision measurement devices, ultrasonic water meters, GPS business and method patents, medical imaging devices, radiation based paper making sensors, computer cooling fans, heavy vehicle braking systems, bicycle suspension systems, and fiber optic amplifiers and multiplexers.

While many of Richard’s cases have involved highly technical fields as described above, others have focused on licensing and other contract disputes, particularly in the Federal District Courts in Connecticut, Massachusetts and New Jersey. Having first-chaired numerous trials during his more than 30 years of practice, he has extensive experience counseling clients regarding their options in litigation and, when advantageous to clients, in negotiating and drafting settlement agreements, including complex payment arrangements.

Richard also presents frequently both in the United States and abroad on patent litigation, attorney-client privilege in patent cases, patent opinion letters, and Paragraph IV notice letters.
