Red Flag Law Can Be Important Tool For School Districts

Anne M. McGinnis, a member of the Harris Beach K-12 Education Industry Team, recently co-authored an article in NYSSBA’s On Board detailing how schools can use New York’s Red Flag Law as a tool to prevent violence.

“It is prudent for schools to coordinate with law enforcement when considering ERPO (Extreme Risk Protection Orders) petitions related to students or upon concerns other individuals who are not students may be at risk of causing harm to self or other,” Anne wrote. “Before a situation of concern arises, school administrators should communicate with local law enforcement to clarify what the Red Flag law is and identify whose responsibilities are whose.”

She went on to detail other actions a school district may want to take: appear at the ERPO hearing with the school attorney, share relevant student records with law enforcement and the courts, seek training from government agencies on threat assessment, increase mental health support in the district.
