Roy W. Breitenbach, an experienced trial lawyer with a focus on the concerns of hospitals, physician practices, skilled nursing facilities and other health care providers, is joining Harris Beach PLLC as a partner.

Roy will be part of the Harris Beach Health Care Industry Team, which advises clients on navigating government regulations, certification, accreditation and compliance issues. The team also advises the industry on operations, litigation, labor, third-party reimbursement, financing, tax, real estate, environmental issues, mergers, acquisitions and affiliations, and other legal matters.

A 1991 graduate of the St. John’s University School of Law, Roy also advises employers across industries on labor and employment issues and business disputes, including “business divorces” and unfair competition issues.

Examples of his health care representative matters include:

• Successfully representing 15 hospitals in a jury trial contending that a major managed care company systemically underpaid the hospitals millions of dollars.
• Obtaining a complete defense verdict on behalf of major New York metropolitan area hospital system in a disability discrimination lawsuit brought by four patients who are deaf, and who contended that system failed to provide them with adequate interpreting services.
• Defending a New York City ENT practice in a protracted dispute with a national managed care company over allegations of fraud and abuse, overbilling, and up-coding, turning an initial claim against his client into a multi-million dollar recovery.
• Successfully defending a New York hospital against whistleblower and retaliation claims brought by a nurse manager contending various health and safety violations, as well as other improper conduct.

Roy will be based at the firm’s Uniondale, New York office and represent clients across New York and the country.
