Local and regional courts have moved to virtual sessions to decrease the number of people in a courtroom. As a result, civil litigation has largely come to a standstill in state courts, while federal courts are still holding some sessions via telecommunications or other methods.

Dale Worrall, Rochester partner and leader of the Harris Beach Business and Commercial Litigation Practice Group, spoke with the Rochester Democrat & Chronicle about how these changes are affecting proceedings. Dale said many civil litigation attorneys are working cooperatively. “To the extent attorneys can work together to exchange documents, complete briefing schedules, even conduct depositions remotely; they’re encouraged to do so.”

Dale also commented that when the pandemic passes, a backlog of civil litigation resulting from COVID-19 is likely, including breach of contract litigation.
