Partner Brian D. Ginsberg was quoted in a Spectrum News New York State of Politics blog article on a recent U.S. Supreme Court ruling that could impact a New York State Law designed to protect children from dangers associated with overconsumption of social media.
The decision ordered lower courts to take another look at laws from Florida and Texas that imposed restrictions on how social media companies can moderate the content posted to their platforms. The ruling defended the platforms’ free speech rights.
According to the article, New York state passed legislation this year which will require parental consent for minors to access predictive algorithms platforms used to curate content.
In the article, Brian said there is language in the decision that could make New York’s law vulnerable to a challenge. He added that protecting children from the dangers of social media overconsumption is laudable but believes the law can be maintained only if the state demonstrates it is “the least restrictive means of advancing a compelling governmental interest.” Brian leads the firm’s Appellate Practice Group and formerly worked in the New York Solicitor General’s Office as an assistant state solicitor general.
