CRITICAL EVIDENCE: GETTING IT IN AND KEEPING IT OUT
In 2022 and 2023, California courts in Berroteran and Ramirez issued decisions with far-reaching impact on how parties can use former testimony and corporate representative testimony at trial. The results have been alternately favorable, and unfavorable, to parties on both sides of the “v,” especially in long-tail product liability and toxic tort litigation. Understanding these decisions is important to practitioners throughout the country, who can expect to eventually be prosecuting or defending this type of litigation in California and elsewhere. Many states have similar legislation, whose future interpretation could be influenced by how the issues are handled by California courts.
