Harris Beach Murtha cybersecurity and data privacy attorney Alan Winchester will present a virtual CLE for the Association of Corporate Counsel of Westchester/Southern CT, “Breaches! What to Expect When You’re Expecting,” on February 5, 2025 at 11:00 am. The session will be moderated by Ralph Carter, Sr. Counsel, Litigation & Cybersecurity Legal, Workday, and Chapter Board Member.
Session Overview:
Breaches seldom occur on Mondays at 9:45 AM after you have had your first cup of coffee. They happen at the worst time – often at the beginning of a long weekend when no one is around to intervene, and everyone is on vacation and difficult to reach. Feedback from our last cybersecurity program revealed that many wanted to know what they can do to help their organization get through the first 24 to 48 hours following the discovery of a breach and before the outside response team is in place. This presentation will advise on the following issues following a significant cyber event:
Preparing for an event
- Defining when an event becomes an incident
- Common incidents in 2024 to incorporate into your incident response plans
- Creating an incident response team and incident response plan
- The role of legal counsel in a security or privacy incident
- The role of a forensic investigator and how to best retain them
- Other potential vendors to help with an incident
The First 24 Hours
- Activating the Incident Response Plan and Team
- Tactics for specific incidents: Email compromise, wire fraud, and ransomware
- Incidents involving cloud service providers
The Next Week
- Potential notifications to regulators and important customers and vendors
The Next Few Months
- Managing employee and customer expectations
- Developing internal and external messaging
- Notifying affected customers and individuals: when and how
How to Close an Incident
- Finalizing the incident log
- Debriefing
- Incorporating lessons learned into both the security plan and the IR plan
